1. Scope of This Policy

This Privacy Policy applies to information collected through our Site, through our patient engagement and lead development services, through direct communications (email, phone, text), and through any other interaction with Convert Health. It does not apply to information collected by third parties whose services you may access through our Site.

2.3 Information from Third Parties

We may receive information about you from third-party sources such as marketing partners, publicly available databases, or referral sources, and combine it with information we already hold about you.

2.4 Protected Health Information

To the extent Convert Health accesses or processes Protected Health Information ("PHI") on behalf of healthcare provider clients, we do so solely as a HIPAA Business Associate under the terms of a signed Business Associate Agreement. PHI is never used for marketing, sold to third parties, or processed beyond what is necessary to deliver contracted services.

3. How We Use Your Information

Convert Health uses the information we collect for the following purposes:

Delivering, operating, and improving our patient engagement, lead development, appointment scheduling, and Voice AI services

Communicating with you about your account, services, and support requests

We do not sell your personal information to third parties. We do not use PHI for any purpose other than performing contracted services.

4. How We Share Your Information

We may share your information in the following limited circumstances:

4.1 Service Providers

We work with third-party vendors who perform functions on our behalf, such as payment processing, cloud infrastructure, SMS and voice platform providers (e.g., Twilio, Telnyx), analytics, and customer relationship management. These vendors access information only as necessary to perform their contracted functions and are bound by confidentiality and data protection obligations.

4.2 Legal Requirements

We may disclose information if required to do so by law, court order, or regulatory authority, or if we believe in good faith that disclosure is necessary to protect our rights, prevent fraud, or protect the safety of our clients or others.

4.3 Business Transfers

If Convert Health is involved in a merger, acquisition, or sale of all or substantially all of its assets, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

4.4 With Your Consent

We may share your information for any other purpose with your explicit consent.

5. SMS/Text Message Program and Opt-In Details

Convert Health may offer an SMS/text message program for people who choose to opt in through our website forms, client onboarding, written agreements, or other Convert Health-controlled consent flows. Users opt in by affirmatively selecting an SMS consent checkbox, submitting a form that includes SMS consent language, or otherwise providing written consent to receive text messages from Convert Health at the phone number provided.

SMS messages may include transactional or service-related communications such as appointment reminders, service confirmations, account alerts, follow-up communications, lead-response updates, and customer support messages. If you separately opt in to marketing or promotional messages, SMS messages may also include marketing updates about Convert Health services.

Message frequency may vary based on your relationship with Convert Health, the services requested, and the communication program selected. Message and data rates may apply. You may opt out of SMS messages at any time by replying STOP. For help, reply HELP or contact kade@converthealth.co.

Providing a phone number alone does not grant SMS consent. SMS consent is optional and is not required to submit a form, request information, purchase services, or otherwise interact with Convert Health.

Convert Health does not share mobile opt-in data, SMS consent records, or phone numbers collected for SMS purposes with third parties or affiliates for marketing or promotional purposes. SMS consent obtained through our services is used solely for the service purpose for which it was obtained and is maintained in accordance with applicable TCPA requirements.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, maintain our business records, comply with legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we securely delete or anonymize it.
